Terms of service.

These terms govern media services booked through visualsamples.media or arranged directly with Visual Samples, a sole-operator real estate media business based in Sarasota, Florida (“Visual Samples,” “I”). Booking a shoot means you accept them. “You” means the person or entity booking — agent, brokerage, owner, or operator.

Bookings are request-based. Completing the online flow submits a request and holds the selected slot; the shoot is confirmed only when you receive a confirmation email. If a request can’t be confirmed — availability, address outside the service area, access issues — you’ll hear promptly and nothing is owed.

No payment is due at booking. Final availability is determined by the property address.

Published prices are starting prices. Final quotes vary by property size and acreage and are shown before you confirm a booking — including any size-based pricing and any extended-area travel fee. The number you confirm is the number invoiced, unless the scope changes at your request after confirmation.

The invoice arrives with your delivered gallery and is due within 7 days of delivery. No deposits are required at this time. Delivered media is licensed to you upon payment in full; galleries may be watermarked or held for accounts significantly past due.

Plans move — listings especially. Reschedule or cancel at no charge with at least 48 hours’ notice. Inside 48 hours, or if the property isn’t accessible at the scheduled time, a rebooking fee may apply before a new date is confirmed. Reply to your confirmation email to change anything — it goes straight to me.

Interior work proceeds on schedule regardless of weather. When weather blocks part of the shot list — a safe drone flight or a clean twilight — the rest of the shoot happens as planned and the blocked portion is rescheduled at no charge. Flight and safety decisions rest with Visual Samples and are final.

You are responsible for lawful access at the scheduled time: lockbox or gate codes, occupant notice, and any HOA or community requirements. The property photographs in the condition it’s in — the prep checklist covers what helps. Shoots include tasteful scene-straightening, not staging, cleaning, or moving furniture.

Visual Samples retains copyright in all delivered media. Upon payment in full you receive the usage license for the package booked, as described in plain language on the licensing page: listing media is licensed for marketing that listing by you and your brokerage; short-term-rental packages include lifetime usage rights for operating that property; commercial licensing is defined in the project quote. Licenses don’t include resale or sublicensing of the files to third parties.

Visual Samples may display delivered work in its own portfolio and marketing. If a listing requires confidentiality, say so in writing before the shoot and it stays out of the portfolio.

Photos are delivered within 24 hours of the shoot via gallery link, including an MLS-sized set. Video, 3D-tour, and reel timelines are confirmed at booking for the package selected. If a deliverable will be late, you hear before the deadline, not after it.

Aerial work is planned around the FAA’s Part 107 rules, and airspace is checked before every flight. Where regulations, airspace, or conditions prohibit flight, aerial deliverables are rescheduled or substituted — no flight happens where the rules say no.

To the fullest extent permitted by law, Visual Samples’ total liability for any claim arising from a shoot or these terms is limited to the amount you paid for the shoot in question, and the first remedy for a deliverable problem is a correction or reshoot. Visual Samples is not liable for indirect or consequential damages, including lost commissions or lost bookings.

These terms are governed by the laws of the State of Florida. Disputes are resolved in the courts of Sarasota County, Florida.

Terms may be updated between bookings; the version in effect when you book (noted at the top of this page) is the one that applies to that shoot. Material changes are posted here with a new date.
